The divorce process is substantially more complicated. With all forms completed, filed correctly and fees paid, your divorce will take a minimum of 6 months. In many cases, it can take more than a year and a half depending on litigation and issues such as: 

  • A more involved divorce with custody, asset allocation, or other issues will add more time (often years) before it is finalized. 
  • Alameda County has a high turnover of judges in the Family courts. With an involved case, the appointing of a new commissioner or judge can further delay your divorce. 
  • Clerical errors; sooner or later you will experience an error by the courts. While DwD strives to provide as much information as possible on how to be proactive to avoid these errors, it is likely you will still encounter an error with your case that can cause a delay.

In short, a divorce in Alameda County can take 6 months to 5 years to complete depending on litigation and the issues listed above.
